Employment Lawyer in Paris
Maître Zied El Air, a lawyer at the Paris Bar, supports employers and employees on all employment law matters: drafting and negotiating employment contracts, termination of the contract, disputes before the employment tribunal (conseil de prud’hommes), harassment and discrimination, collective labour relations. The firm, located Place Saint-Michel in the 5th arrondissement of Paris, provides advice as well as litigation, with particular attention to risk prevention and to seeking negotiated solutions where possible.
Employment contracts
The firm supports its clients in drafting, negotiating and reviewing employment contracts: permanent contracts (CDI), fixed-term contracts (CDD), part-time work, probationary periods, special clauses (non-competition, mobility, confidentiality, training repayment, exclusivity), amendments and changes to the contract. It also advises on choosing the appropriate contract and on how it fits with the applicable collective agreement.
Termination of the employment contract
Dismissal
The firm advises in particular on dismissal for personal reasons (simple, serious or gross misconduct, professional inadequacy, unfitness for work) and on dismissal for economic reasons. For the employer, it secures the procedure and the reasons given for the decision; for the employee, it analyses the regularity and merits of the dismissal and supports any challenge.
Mutually agreed termination (rupture conventionnelle)
The rupture conventionnelle allows the employer and the employee to agree jointly on the terms of the termination of a permanent contract. The firm supports the negotiation, the drafting of the agreement and the monitoring of the approval (homologation) procedure.
Termination by the employee (prise d’acte) and judicial termination
Where the employee complains of sufficiently serious breaches by the employer, the employee may take formal note of the termination (prise d’acte) or apply to the employment tribunal for judicial termination of the contract. The firm advises on whether such proceedings are advisable and conducts them.
Employment tribunal disputes (conseil de prud’hommes)
The firm represents employers and employees before the employment tribunal (conseil de prud’hommes) and the court of appeal: challenges to dismissal, claims for back pay and overtime, requalification of contracts, termination payments, unfair performance of the contract. It intervenes from the pre-litigation stage and, where the client’s interest requires it, favours settlement solutions.
Harassment and discrimination at work
The firm advises on moral harassment, sexual harassment and discrimination: supporting employees in building their case and exercising their rights; supporting employers in prevention (duty of safety, internal procedures, investigations) and in handling reports.
Collective labour relations
Collective agreement
Determining the applicable collective agreement, analysing its provisions (classification, pay, working time, notice periods) and how they fit with the employment contract and company agreements.
Social and Economic Committee (CSE)
Supporting employers in setting up and running the Social and Economic Committee (CSE): organising staff elections, powers, information and consultation, relations with staff representatives.
