Managers magazine (No. 323, November 2025) interviewed Maître Zied El Air, a lawyer at the Paris and Tunisian Bars, on the legal challenges posed by agentic AI, that is, artificial intelligence systems capable of making decisions autonomously.
In this interview, Maître El Air discusses in particular the absence, to date, of a Tunisian law specific to autonomous artificial intelligence, the limits of the current texts (Organic Law No. 2004-63 on the protection of personal data and Decree-Law No. 2023-17 on cybersecurity) for regulating these technologies, and the avenues under consideration to fill this legal gap: reversing the burden of proof in favour of the claimant, compulsory insurance for high-risk systems, and strengthening the contractual clauses between the parties.
